Frequently asked questions

What should I do straight after a redundancy meeting?

Write down what you were told, then send a short email confirming your last day, how notice will be handled, and asking for a written breakdown of your final pay.

Am I entitled to redundancy pay?

It depends on your length of continuous service, your employer's size and your award, agreement or contract. Most small business employers are exempt under the National Employment Standards. The Fair Work Ombudsman has the full rules and a calculator.

What records should I keep when I am made redundant?

Your payslips, contract, a statement of service, referee contact details, and copies of positive feedback. You can also ask for an Employment Separation Certificate if you need one for Services Australia.

What if I think the redundancy is not genuine?

Get advice quickly from your union, a community legal centre or an employment lawyer. Unfair dismissal applications to the Fair Work Commission must be lodged within 21 days of your employment ending.
